ఈ Blog లో మనం రివ్యూ పిటిషన్ అంటే ఏమిటో తెలుసుకుందాం. అలాగే మనకు తరచుగా వినిపించే ఇంకొక అంశం రివిజన్ పిటిషన్. ఈ రెండింటికి గల తేడా ఏమిటి అనేది మనం ఒకసారి చూద్దాం.
☑️ రివ్యూ పిటిషన్ అంటే ఏమిటి?
ముందుగా రివ్యూ పిటిషన్ కనుక చూస్తే మనకు తరచుగా పేపర్లో వచ్చే అంశము ఈ రివ్యూ పిటిషన్. దీని ద్వారా ఏమవుతుంది అంటే? ఉదాహరణకు సుప్రీంకోర్టు ఒక తీర్పు ఇచ్చినప్పుడు ఆ తీర్పును మళ్ళీ సమీక్షించమని సుప్రీంకోర్టును కోరడమే – రివ్యూ పిటిషన్. అంటే రివ్యూ పిటిషన్ ఎప్పుడూ కూడా ఏ కోర్టు అయితే తీర్పు ఇచ్చిందో.. ఆ కోర్టుకు వెళ్లి మళ్లీ ఒకసారి అప్పీలు చేసుకుని ఒక పిటిషన్ సమర్పించి, మీరు ఇచ్చిన తీర్పును ఒకసారి పునఃసమీక్షించండి అని కోరడమే — రివ్యూ పిటిషన్. 📌
అయితే ఈ టాపిక్ మనకు ఇప్పుడు డిస్కషన్ లో ఎందుకు ఉంది?
మనము ఈ మధ్యనే చూసిన టాపిక్ economically weaker section of the society. వీరికి రాజ్యాంగాన్ని సవరించి రిజర్వేషన్లు కల్పించడం జరిగింది. ఇది 2019లో జరిగింది మనకు ఆ విషయం తెలుసు. అయితే మరి అలా రిజర్వేషన్లు పొడిగించడం వలన ఈ రిజర్వేషన్ల శాతం 50కి మించిపోతుంది కాబట్టి అటువంటి రిజర్వేషన్లు చెల్లవు అని సుప్రీంకోర్టు 1992లో ఇందిరా సహాని కేసులో ఇచ్చిన తీర్పు ఆధారంగా కొంతమంది సుప్రీంకోర్టుకు వెళ్ళినప్పుడు సుప్రీంకోర్టు ఆ పిటిషన్ని కొట్టివేయడం జరిగింది. 🚫 అంటే ఇక్కడ EWS రిజర్వేషన్ ని సుప్రీంకోర్టు సమర్థించడం అనేది జరిగింది. ఆ విషయం కరెంట్ అఫైర్స్ లో చూసాం.
అయితే ఇక్కడ Backward Classes Federation – ఈ సంస్థ సుప్రీంకోర్టుకు వెళ్లి ఇలా ఈ రిజర్వేషన్ ఇస్తూ ఉండటం వలన మన దగ్గర ఉన్నాయి Fraternity Concept ఏదైతే ఉందో దానిని డివైడ్ చేస్తూ ఉన్నాం. మరి Fraternity అన్నప్పుడు అందరినీ సమానంగా చూడాలి. మరి ఆ విధంగా ఈ రిజర్వేషన్లు ఇస్తూ పోతూ ఉంటే ఎవరికైతే రిజర్వేషన్ ఉండదో వారికి అన్యాయం జరుగుతున్నట్టే కదా!! కాబట్టి మీరు ఇచ్చిన తీర్పును ఒకసారి పున సమీక్షరించండి అని సుప్రీంకోర్టుకు వెళ్లి ఆ రివ్యూ పిటిషన్ను సమర్పించడం జరిగింది.
రివ్యూ పిటిషన్ను కచ్చితంగా ఆమోదించవలసిన అవసరం ఉందా?
ఇంకొక ముఖ్యమైన విషయం ఏమిటి అంటే – రివ్యూ పిటిషన్ను కచ్చితంగా ఆమోదించవలసిన అవసరం లేదు.
రివ్యూ పిటిషన్ ఎప్పుడు ఆమోదిస్తారు అంటే?
తాను ఇచ్చిన తీర్పులో ఏదైనా ఎర్రర్ ఉంది అన్నప్పుడు లేదా స్పష్టంగా కనిపించే ఏదైనా కొన్ని ముఖ్యమైన అంశాలను పరిగణలోనికి తీసుకోలేదు అని కోర్టు భావించినప్పుడు ఆ రివ్యూ పిటిషన్ను యాక్సెప్ట్ చేయడం జరుగుతుంది.
అంటే దీని యొక్క అర్థం ఏమిటి?
రివ్యూ పిటిషన్ పెట్టాం కాబట్టి కచ్చితంగా సుప్రీంకోర్టు ఆమోదించవలసిన అవసరం లేదు. ❌️
కానీ ఈ కేసులో సుప్రీంకోర్టు రివ్యూ పిటిషన్ను ఆమోదించడం జరిగింది. ఇచ్చిన తీర్పును పునఃసమీక్షరించడానికి సుప్రీంకోర్టు ఒప్పుకోవడం జరిగింది. వెరీ వెరీ ఇంపార్టెంట్. 📌📌
☑️ రివిజన్ పిటిషన్ అంటే ఏమిటి?
అలాగే ఇక రివిజన్ పిటిషన్ కు వచ్చేటప్పటికి ఏమిటి అంటే? కింది కోర్టులు ఇచ్చిన తీర్పును ఒకసారి సరి చూడమని పైకోర్టుకు విన్నవించుకోవడమే రివిజన్ పిటిషన్.
రివ్యూ పిటిషన్ ఎప్పుడు కూడా ఏ కోర్టు అయితే తీర్పు ఇచ్చిందో.. ఆ కోర్టులో మళ్లీ మీరు ఇచ్చిన తీర్పును పునఃసమీక్షరించండి అని కోరడమే రివ్యూ పిటిషన్.
రివిజన్ పిటీషన్ వచ్చినప్పటికీ కింది కోర్టు ఇచ్చిన తీర్పు గురించి పై కోర్టుకు వెళ్లడం – రివిజన్ పిటీషన్.
మనకు రివ్యూ పిటిషన్ అనే అంశము తరచుగా పేపర్లో వస్తూ ఉంటుంది. వీటి మీద గతంలో ప్రశ్నలు వచ్చాయి. మళ్లీ మళ్లీ వచ్చే అవకాశం ఉంది. కాబట్టి జాగ్రత్తగా ఇవన్నీ మీరు ఫాలో కావాలి.
What is the difference between a Review petition and a Revision petition?
Today in class we will learn what a review petition is. Also another topic that we often hear is Revision Petition. Let us see the difference between the two.
☑️ What is a Review Petition?
First of all, the review petition is the topic that we often come across in the paper. What does this mean? For example, when the Supreme Court gives a judgment, it is a request to the Supreme Court to review that judgment again – a review petition. Which means the review petition has always been decided by any court... Go to that court and appeal again and submit a petition and ask for a review of the judgment you have given — a review petition. 📌
But why do we have this topic in discussion now?
The topic we have seen recently is economically weaker section of the society. Constitution was amended and reservations were made for them. This happened in 2019 and we know that. However, when some people went to the Supreme Court based on the judgment given by the Supreme Court in the Indira Sahani case in 1992 that the percentage of these reservations would exceed 50, the Supreme Court dismissed the petition. 🚫 Means here Supreme Court upheld EWS reservation. We saw that in current affairs.
But here Backward Classes Federation – this organization is going to the Supreme Court and giving this reservation, so we are dividing whatever Fraternity Concept we have. And when it comes to Fraternity, everyone should be treated equally. And if these reservations continue to be given like that, then injustice is being done to those who do not have reservations!! So you have gone to the Supreme Court to review the judgment and submitted that review petition.
Whether the review petition needs to be allowed strictly?
Another important point is – the review petition need not be accepted outright.
When will the review petition be approved?
A review petition is accepted when the court feels that there is any error in the judgment passed by it or that it has not considered some important point which is obvious.
So what does this mean?
Since we have filed a review petition, there is no need for the Supreme Court to approve it. ❌️
But in this case the Supreme Court has accepted the review petition. The Supreme Court agreed to review the verdict. Very very important. 📌📌
Also, what does it mean when it comes to a revision petition? A revision petition is a request to the higher court to revise the judgment given by the lower courts.
A review petition is a request to review the judgment given by the court which has given the judgment.
Going to the higher court against the judgment given by the lower court despite a revision petition – Revision Petition.
